We are not responsible for any improper use of NewsFromJules.com services, information, links, articles or any other content gathered from our website. All orders that are placed through Popular Marketing.com are subject to the following terms and conditions. By placing an order it is understood that you have read, comprehended and agreed with these terms.

Client acknowledges that by placing an order with Popular Marketing.com that they have read, acknowledged and fully understood ALL paragraphs of these terms and conditions. All services will begin within 48 hours from the purchase time. All services are conducted on a first come, first serve basis. If you pay by online check or credit card, the campaign starting date shall be the date on which your check or credit card payment clears.

Due to variances in amounts of traffic purchased at different times, the starting date may fluctuate, and we are in no way to be held responsible if your campaign does not start by a specific date.

All visitor campaigns will be completed in 60 days. If we are unable to deliver all of your visitors within the 60 day time frame you are eligible for a refund. This refund will be issued on a pro-rata basis.

In cases where refunds are claimed, we reserve the right to require proof that the proper number of visitors were not delivered. Stats, Data and other information from third party counters (e.g. Extreme-DM.com, hitbox) are not sufficient to establish a claim. These counting systems tend to yield an improper count. If we dispute your claim, you must provide us with RAW server logs from the site and time period in question - this is the only reliable method of counting a visitor.

NewsFromJules.com cannot be held responsible for factors beyond our control that may interfere with our ability to deliver visitors to your URL. Such factors include, but are not limited to: downtime on your server, overuse of your bandwidth quota (if applicable), errors on your site and network outages beyond our servers. Please contact your web hosting company or network provider if you are unsure about whether your hosting account is sufficient for the traffic amount you are ordering.

NewsFromJules.com will in no way be held responsible for slow server bandwidth. We will in no way be held responsible for determining the server bandwidth capabilities of customer sites.

NewsFromJules.com will not be responsible for incorrect URL's. This is the responsibility of the client to verify the correct URL. We will in no way be held responsible for this type of mistake.

Client understands that 3rd party hit counters on your site do not accurately represent the number of visitors to your site or the number of ads we served. This is due to the large amounts of traffic sent to the site in a relatively short timeframe. Most 3rd party counters cannot keep up accurately. Client also understands that Popular Marketing.com DOES NOT GUARANTEE YOUR SALES.

In no event shall NewsFromJules.com be liable for any consequential, direct, indirect, incidental, punitive, or other damages whatsoever (including, but not limited to, damages for loss of profits, loss of information or other pecuniary loss) arising out of the use or inability to use the package, even if Popular Marketing has been advised of the possibility of such damages.

In the event that there is a discrepancy between the amount of traffic delivered by us, and the amount of traffic delivered to the client, on their behalf NewsFromJules.com and the client both agree to use the report prepared by the traffic supplier.

ADVERTISING WITHIN THE FTC GUIDELINES

The FTC is really ramping up to crack down on Internet Marketers, and actively go after

those of us that don't rigidly adhere to all their rules about disclosure and documentation!

The Internet is connecting advertisers and marketers to customers from Boston to Bali with

text, interactive graphics, video and audio. If you're thinking about advertising on the Internet,

and especially if you are selling “income opportunities” remember that many of the same rules

that apply to other forms of advertising apply to electronic marketing. These rules and guidelines

protect businesses and consumers - and help maintain the credibility of the Internet as an

advertising medium.

When it comes to online ads, the basic principles of advertising law apply:

•  Advertising must be truthful and not misleading;

•  As explained in the FTC's Deception Policy Statement, an ad is deceptive if it contains a statement—or omits information—that is likely to mislead consumers acting reasonably under the circumstances and is "material" or important to a consumer's decision to buy or use the product

•  Advertisers must have evidence to back up their claims ("substantiation");

•  Before disseminating an ad, advertisers must have reasonable support for all express and implied objective claims that the ad conveys to consumers. When an ad lends itself to more than one reasonable interpretation, there must be substantiation for each interpretation. The type of evidence needed to substantiate a claim may depend on the product, the claims, and what experts believe is necessary. If an ad specifies a certain level of support for a claim—"tests show x"—the advertiser must have at least that level of support.

•  Advertisements cannot be unfair.

•  According to the FTC Act, 15 U.S.C. § 45(n) and the FTC's Unfairness Policy Statement, an advertisement or business practice is unfair if it causes or is likely to cause substantial consumer injury that consumers could not reasonably avoid and that is not outweighed by the benefit to consumers or competition.
